The Man Behind Contemporary Constitutional Law Design

In today’s society, we are surrounded by various ethnicity and languages, religions and cultures, preferences and beliefs. In order to embrace these differences and live hand in hand together peacefully, we must challenge our constitutional law to encourage democracy and social justice for all. The design of this law must be mindful to these differences. But how exactly should we be mindful?

 

This question is one of the major discussions in the book “Constitutional Design for Divided Societies: Integration or Accommodation?” written by Sujit Choudhry. In the book, he mentions two main points of views that exist within the law community as an answer to this question. One of them accommodates and empowers differences by recognizing the people’s rights, which leads to the formation of multinational federalism and other forms of minority rights, such as the right to receive minority language and religious education. The other point of view feels that these practices will further aggravate the division amongst the people, and suggested a different approach such as designing bills of rights under judicial review that protects universal human rights.
